Necessary to fill jars to the top?

I'm sure this is a stupid question, but I'll ask anyway. I followed a recipe for damson gin and put the fruit and sugar in a 1L preserving jar. Unfortunately there was only enough room for me to add about half the gin I needed. Can I part fill a 2L jar instead or would it spoil if the jar wasn't filled to the top?

I haven't found it necessary to fill the jar when making sloe gin or damson gin. In fact, it seems to be helpful not to fill the jar completely as, if you agitate it by turning it upside down and shaking, the splashing effect helps to dissolve any sugar sitting at the bottom.
